Terms and Conditions between My Ticket and Event Hosts
1. Agreement Overview By registering and using My Ticket for event ticketing, the Event Host agrees to the following terms and conditions. This agreement establishes the responsibilities, rights, and limitations of both My Ticket and the Event Host.
2. Registration and Account
• My Ticket will create the event description on myticket.co.ke using information provided by the event host.
• The Event Host is responsible for keeping login information confidential and must notify My Ticket immediately if there is unauthorized use of their account.
3. Event Posting and Ticket Sales
• Event Hosts are responsible for accurately describing their events and ticket details, including date, location, pricing, and any specific terms.
• My Ticket reserves the right to review and, if necessary, remove event listings that violate the platform’s guidelines or local laws.
• Event Hosts are solely responsible for obtaining necessary permits, licenses, and insurance to host their events.
4. Fees and Payments
• My Ticket charges a 10% service fee for each ticket sold through the platform.
• Service fees are non-refundable unless otherwise specified by My Ticket.
• Payment will be processed and remitted to Event Hosts on the eve of the event day or as agreed by the two parties, minus applicable service fees and any refunds issued.
5. Refunds and Cancellations
• Event Hosts must set and communicate their refund policies clearly. If no specific policy is set, My Ticket’s default refund policy will apply.
• In case of event cancellation, postponement, or rescheduling, the Event Host is responsible for issuing refunds to ticket buyers. My Ticket may assist with processing these refunds but does not hold liability for the funds or obligations related to them.
• If an event is canceled by the Event Host, My Ticket may charge a cancellation fee.
6. Compliance with Laws and Policies
• The Event Host agrees to comply with all applicable laws, regulations, and platform policies, including but not limited to health and safety requirements.
• The Event Host must not engage in illegal activities or allow prohibited behavior (such as violence, discrimination, or hate speech) at their events.
7. Intellectual Property and Branding
• The Event Host grants My Ticket a non-exclusive, royalty-free license to use the event details, trademarks, and images provided for promotional and marketing purposes on the platform.
• My Ticket retains the right to modify or remove content that infringes on intellectual property rights or violates platform guidelines.
8. Liability and Indemnification
• My Ticket provides an online platform for ticket sales but does not assume responsibility for the event’s organization, safety, or attendee experience.
• The Event Host indemnifies My Ticket against any claims, damages, losses, or expenses arising from their event, including but not limited to injury, property damage, or legal claims.
• My Ticket’s liability to the Event Host is limited to the service fees collected from ticket sales, excluding any other form of liability.
9. Data Protection and Privacy
• My Ticket complies with applicable data protection laws and policies, including user data protection and privacy.
• The Event Host agrees to only use attendee data provided by My Ticket for event-related communications and not for unsolicited marketing or spam.
10. Termination
• Either party may terminate this agreement upon written notice. However, event listings cannot be removed from My Ticket once ticket sales have commenced, except in cases of event cancellation.
• Upon termination, the Event Host is still responsible for fulfilling all obligations related to sold tickets and event delivery.
11. Modification of Terms
• My Ticket reserves the right to modify these terms and conditions at any time. Event Hosts will be notified of any material changes, and continued use of the platform constitutes acceptance of the revised terms.
12. Governing Law
• This agreement is governed by the laws of Kenya. Any disputes arising from these terms will be resolved under the jurisdiction of Kenyan courts.
